Choose เป็น when a noun phrase characterizes someone or something by class, role, status, or a conventional state. Choose อยู่ when an identifiable entity is at, lives at, or remains in a location; after another predicate, อยู่ can instead show that a situation continues. English uses be for all of these, but Thai makes the predicate relation visible.
The shortcut “เป็น is permanent, อยู่ is temporary” is wrong. วันนี้ฉันเป็นคนขับรถ assigns a temporary role with เป็น, while วัดนี้อยู่ริมแม่น้ำมาหลายร้อยปีแล้ว describes a centuries-long location with อยู่. Predicate type, not duration, controls the basic choice.

Step 1: Does the complement name a profession, type, or assigned role?
Use เป็น. The role may last a lifetime or only one afternoon.
น้องชายผมเป็นช่างภาพครับ

My younger brother is a photographer. (ordinary polite report, male speaker; profession)
บ่ายนี้คุณดาวเป็นคนรับโทรศัพท์ค่ะ

This afternoon Khun Dao is the person answering the phone. (ordinary polite report, female speaker; temporary assigned role)
กล่องใบนี้เป็นภาชนะสำหรับเก็บยาแห้งครับ
klong bai ni pen phachana samrap kep ya haeng khrap
This box is a container for storing dry medicine. (formal-neutral explanation, male speaker; object classified by function)
Thai has no article before a profession. เป็นช่างภาพ corresponds to English “is a photographer,” but เป็น carries the class relation, not the article.
Step 2: Does the sentence locate an identifiable entity?
Use อยู่ + place. The entity is normally known from context, a demonstrative, possession, a name, or an identifying description.
ตอนนี้น้องชายผมอยู่ที่สตูดิโอครับ
ton ni nong chai phom yu thi satudio khrap
My younger brother is at the studio now. (ordinary polite information, male speaker; known person located)
โทรศัพท์ของคุณดาวอยู่บนโต๊ะข้างหน้าต่างค่ะ
thorasap khong khun dao yu bon to khang natang kha
Khun Dao's phone is on the table beside the window. (ordinary polite information, female speaker; possessed object located)
บ้านของคุณตาอยู่ใกล้สถานีรถไฟครับ
ban khong khun ta yu klai sathani rot fai khrap
Grandfather's house is near the railway station. (ordinary polite information, male speaker; stable location)
Permanence does not force เป็น. A building, mountain, or city can remain in one place indefinitely and still takes locative อยู่.
Step 3: Is อยู่ after another predicate?
Then it may present an activity, property, or result as continuing rather than supply physical location. Position matters.
ไฟในห้องเก็บของยังเปิดอยู่ค่ะ
fai nai hong kep khong yang poet yu kha
The light in the storeroom is still on. (ordinary polite report, female speaker; continuing result state)
เด็ก ๆ กำลังอ่านหนังสืออยู่ครับ
dek dek kamlang an nangsue yu khrap
The children are reading. (ordinary polite report, male speaker; ongoing activity)
Compare คุณดาวอยู่สำนักงาน “Khun Dao is at the office,” where อยู่ precedes a place, with คุณดาวรออยู่ “Khun Dao is waiting,” where it follows the activity. The second is not a rival to classifying เป็น.
Step 4: Is the complement an ordinary property?
Choose neither. Thai words such as สูง “tall,” แพง “expensive,” and เงียบ “quiet” function directly as predicates.
อาคารฝั่งตะวันตกสูงกว่าสำนักงานเราค่ะ
akhan fang tawan tok sung kwa samnakngan rao kha
The building on the west side is taller than our office. (ordinary polite comparison, female speaker; direct property predicate)
Adding เป็นสูง or อยู่สูง to imitate English is tall changes or breaks the construction. See zero property predicates.
Minimal pairs: one person, two questions
Hold the vocabulary constant and change the requested information.
คุณปกรณ์เป็นแพทย์ที่โรงพยาบาลนี้ครับ
khun pakon pen phaet thi rongphayaban ni khrap
Khun Pakon is a doctor at this hospital. (ordinary polite characterization, male speaker; profession)
คุณปกรณ์อยู่ที่โรงพยาบาลนี้ครับ

Khun Pakon is at this hospital. (ordinary polite location report, male speaker)
วันนี้คุณนิดเป็นหัวหน้าเวรค่ะ
wan ni khun nit pen hua na wen kha
Today Khun Nit is the shift supervisor. (ordinary polite report, female speaker; assigned role)
วันนี้คุณนิดอยู่ห้องฉุกเฉินค่ะ
wan ni khun nit yu hong chukchoen kha
Today Khun Nit is in the emergency room. (ordinary polite report, female speaker; workplace location)
Time expression วันนี้ appears with both. It locates the assertion in time but does not decide whether the predicate is role or place.
Ambiguous English: add the missing Thai relation
English “This is my home” can either identify the place as one’s home or locate a particular home. Thai packages those meanings differently.
ที่นี่เป็นบ้านของฉันค่ะ ไม่ใช่สำนักงาน
thi ni pen ban khong chan kha mai chai samnakngan
This place is my home, not an office. (ordinary polite clarification, female speaker; place characterized by function)
บ้านของฉันอยู่ตรงหัวมุมค่ะ
ban khong chan yu trong hua mum kha
My house is on the corner. (ordinary polite information, female speaker; identifiable house located)
The deictic ที่นี่ anchors a place near the speaker. It still does not license locative อยู่ if the speaker’s actual job is to classify that place as “home.” Conversely, a known house takes อยู่ when its position is at issue.
Negation and scope
Plain negative class membership normally uses ไม่ใช่, whereas negative location uses ไม่อยู่.
ผู้หญิงคนนั้นไม่ใช่พนักงานของเราค่ะ
phu ying khon nan mai chai phanak ngan khong rao kha
That woman isn't one of our employees. (ordinary polite correction, female speaker; class negation)
พนักงานของเราไม่อยู่ที่เคาน์เตอร์ครับ
phanak ngan khong rao mai yu thi khaotoe khrap
Our employee isn't at the counter. (ordinary polite information, male speaker; known person's location denied)
ไม่ได้เป็น can contrastively deny a role: ผมไม่ได้เป็นคนสั่งซื้อ “I wasn't the person who ordered it.” ไม่เป็น also appears in learned-skill and change-of-state constructions, such as ขับรถไม่เป็น “not know how to drive.” Those meanings do not make ไม่เป็น the automatic opposite of every classifying เป็น.
Ordinary-polite dialogue
คุณเมย์เป็นพนักงานสาขานี้หรือเปล่าคะ
khun me pen phanak ngan sakha ni rue plao kha
Is Khun May an employee at this branch? (ordinary polite question, female speaker; affiliation)

อาคารนี้เป็นศูนย์ประสานงานชั่วคราวใช่ไหมคะ

Is this building the temporary coordination center? (formal site-inspection question, female speaker; institutional function)

Common Mistakes
1. Using เป็น for physical location
❌ กระเป๋าเอกสารเป็นใต้โต๊ะค่ะ
Incorrect—ใต้โต๊ะ is a physical location, not a class or role.
✅ กระเป๋าเอกสารอยู่ใต้โต๊ะตัวกลางค่ะ
krapao ekkasan yu tai to tua klang kha
The document bag is under the middle table. (ordinary polite information, female speaker)
2. Using อยู่ for a profession
❌ คุณวิทยาอยู่ผู้ตรวจสอบบัญชีครับ
Incorrect—ผู้ตรวจสอบบัญชี names a profession, not a place.
✅ คุณวิทยาเป็นผู้ตรวจสอบบัญชีครับ
khun witthaya pen phu truat sop banchi khrap
Khun Witthaya is an auditor. (formal-neutral characterization, male speaker)
3. Treating permanence as the rule
❌ วันนี้ผมอยู่คนขับรถให้ทีมครับ
Incorrect—even though the assignment is temporary, คนขับรถ is a role and takes เป็น.
✅ วันนี้ผมเป็นคนขับรถให้ทีมครับ
wan ni phom pen khon khap rot hai thim khrap
Today I'm the team's driver. (ordinary polite report, male speaker; temporary role)
4. Inserting either form before a property
❌ ห้องชั้นบนอยู่ร้อนมากค่ะ
Incorrect for a simple property; ร้อน predicates directly.
✅ ห้องทำงานชั้นบนร้อนมากค่ะ
hong tham ngan chan bon ron mak kha
The upstairs office is very hot. (ordinary polite report, female speaker)
5. Using ไม่เป็น for plain negative classification
❌ อาคารหลังนี้ไม่เป็นโรงพยาบาลครับ
Wrong for straightforward class negation; use ไม่ใช่.
