Annotated Medieval Charter Fragment

Medieval charters combine narration, theology, institutional formula, and enforceable disposition. They are also transmitted through photographs and scholarly editions whose conventions differ. This page uses Stefan Nemanja's Hilandar founding charter, issued in 1198–1199: one short diplomatic excerpt is reproduced from a cited scholarly transcription, while the legal disposition is given in Dimitrije Bogdanović's published modern Serbian translation as reproduced by Hilandar's document portal. The two layers are labeled because a translation must never be presented as the manuscript's letter-by-letter text.

The Witness and the Editorial Layers

The original charter is kept at Hilandar. Its language is Serbian Church Slavonic with more vernacular material in the dispositive sections. A diplomatic transcription tries to preserve historically significant letter forms and word shapes; a normalized edition resolves more of the script; a translation recasts the syntax in modern Serbian.

The following arenga clause is a diplomatic excerpt as quoted in a University of Novi Sad legal-historical study. Its ellipsis is the modern scholar's omission mark, not damage silently reconstructed here:

Тѣмьже братие Богь прѣмилостивыи оутврьди Грьке царьми а Оугре кральми... и постави ме велиега жоупана, нареченога вь свѣтѣмь крьщени Стѣфана Неманоу

Therefore, brothers, the most merciful God established the Greeks as emperors and the Hungarians as kings... and appointed me grand župan, named Stefan Nemanja in holy baptism.

The forms Тѣмьже, прѣмилостивыи, велиега, жоупана, Неманоу are not modern misspellings. They represent an editorial transcription of a medieval written system. Characters such as ь, ѣ, and the digraph оу must be read according to the edition's conventions, not converted by visual resemblance to Russian.

💡
A diplomatic line is edition-dependent. Copy the editor's characters exactly and cite that edition; do not "improve" a letter because another Slavic language uses a more familiar modern symbol.

The complete study fragment below follows Bogdanović's modern Serbian translation of the charter's closing disposition. It is a translation of the medieval text, not a diplomatic transcription.

И ако ко од манастирских људи или Влаха побегне под великога жупана или код кога другог, да се опет враћају;

And if any of the monastery's people or Vlachs flee to the grand župan or to anyone else, they are to be returned;

ако ли од жупанових људи дођу у манастирске људе, да се опет враћају.

and if any of the župan's people come among the monastery's people, they too are to be returned.

И све што дадох манастиру у Свету Гору, да не треба ни моме детету, ни моме унучету, ни моме рођеноме, ни коме другоме.

And everything I gave to the monastery on the Holy Mountain is to belong neither to my child, nor my grandchild, nor my kin, nor anyone else.

Ако ли ко ово измени, да му Бог суди и да му је Света Богородица супарница на страшном суду оном и ја грешник Симеон.

If anyone alters this, may God judge him, and may the Holy Mother of God be his adversary at that Last Judgment—and I, the sinner Simeon, as well.

The social category named Власи belongs to the charter's medieval legal and economic world. It must not be mapped mechanically onto a present-day identity label. The translation's capital letter is an editorial choice; historical interpretation requires the charter's institutional context.

Condition Plus Norm: ако ... да

The disposition repeatedly uses a conditional protasis followed by a да clause. In modern conversation, English learners often expect a future indicative after if. Here да се опет враћају does not predict what will happen; it formulates what must happen. The legal force comes from the charter and the construction's directive value.

Ако неко напусти посед, да се врати под власт којој припада.

If anyone leaves the estate, that person is to be returned to the authority to which they belong.

That sentence is a modern explanatory paraphrase. It is not a quotation from the charter. Contemporary legal Serbian would usually choose more explicit normative wording such as мора се вратити or враћа се, depending on drafting convention.

The enclitic-like ли in ако ли adds a contrastive continuation: if, on the other hand. It organizes reciprocal cases—movement away from monastic authority and movement toward it—without repeating the whole frame.

Case Syntax

The fragment remains useful for modern case reading even though its social world is remote.

PhraseCase/functionMeaning
од манастирских људиgenitive after одfrom/among the monastery's people
под великога жупанаaccusative after directional подinto the grand župan's jurisdiction
код кога другогgenitive after кодto/at someone else's domain
моме дететуdative after the translated predicateto/for my child
да му Бог судиdative object of судити; affected partymay God judge him

Directional под + accusative is crucial. Под великим жупаном with instrumental would describe a static relation under the grand župan, not movement into his jurisdiction. For related historical patterns, see historical case remnants.

Formula, Authority, and Sanction

The charter first anchors rank in a providential hierarchy: God establishes rulers and, in the cited transcription, постави ме велиега жоупана. The modern translation renders this постави ме великога жупана. In both versions, the accusative phrase agrees with object ме; English instead prefers appointed me grand župan without visible case agreement.

The closing curse is a sanction formula. Да му Бог суди and да му је света Богородица супарница are optative да clauses: they invoke judgment against a future violator. Ја грешник Симеон is syntactically compressed. Its force is approximately and I, the sinner Simeon, [will be his adversary]; the shared predicate is recoverable from the previous clause.

Нека му суди Бог, а и ја, грешник Симеон.

May God judge him—and I, the sinner Simeon, will do so too.

That is a modern reading aid which makes the ellipsis explicit. It should not replace the more compact formula in a quotation.

Obsolete Letters Are Not Sounds by Themselves

Final ь in forms such as Богь and вь is part of historical orthographic practice; it does not mean that a modern reader should append a Russian-style vowel. оу in Неманоу reflects an editorial representation of medieval spelling. Yat and other historical graphs vary across documents and editions. Paleographic interpretation depends on the manuscript hand, abbreviation system, and editor's key.

There is no honest one-line algorithm that converts any medieval Serbian charter into modern Cyrillic. Abbreviations, superscript letters, damaged writing, and morphologically meaningful spellings require editorial judgment. The pre-Vuk orthographies page supplies the wider history; a specialist edition supplies the reading of this witness.

Register and Historical Framing

The charter is (historical/legal) and (ecclesiastical), not a model for contemporary administrative prose. Its hierarchy and rules belong to a medieval institution. Translating велики жупан simply as president or манастирски људи as employees would erase the categories being studied.

The first-person humility formula ја грешник Симеон coexists with forceful authority. It should not be read as casual self-deprecation. In the genre, spiritual humility and legal command perform different but compatible functions.

Common Mistakes

Calling the modern translation diplomatic

❌ Дипломатски текст гласи: „И ако ко од манастирских људи...“

Incorrect labeling—this wording is the cited modern Serbian translation, not the manuscript's diplomatic transcription.

✅ У модерном преводу стоји: „И ако ко од манастирских људи...“

The modern translation reads: 'And if any of the monastery's people...'

Replacing historical letters with Russian conventions

❌ Нєманоу ћу преписати као Неманью јер ми тако изгледа познатије.

Incorrect—this imports a modern Russian spelling convention not licensed by the Serbian charter edition.

✅ Облик Нєманоу преносим тачно према наведеном дипломатском издању.

I reproduce Нєманоу exactly from the cited diplomatic edition.

Flattening directional case

❌ Побегао је под великим жупаном.

Incorrect for the charter's directional meaning—the instrumental makes the relation static.

✅ Побегао је под великога жупана.

He fled into the grand župan's jurisdiction.

Treating a medieval social label as timeless

❌ Реч „Влах“ у сваком веку означава исту савремену националност.

Incorrect—its reference depends on period, document type, and social context.

✅ У овој повељи термин тумачимо у оквиру средњовековног правног поретка.

In this charter, we interpret the term within the medieval legal order.

Key Takeaways

  • Keep the diplomatic transcription, normalized reading, and modern translation visibly separate.
  • Read ако ... да as condition plus directive, and the closing да clauses as sanctions or wishes.
  • Case remains semantically active: directional под + accusative differs from static под + instrumental.
  • Historical letters and social terms require an edition and context; neither can be converted by visual guesswork.

Reuse Exercises

  1. Divide the legal fragment into condition, directive, property exclusion, and sanction. Identify every да clause and explain whether it is directive or optative.
  2. Produce a modern administrative paraphrase using мора and не припада, then list what the paraphrase loses in formula, theology, and social terminology.
  3. Copy the diplomatic arenga exactly. Circle every form that cannot be modernized mechanically and state what edition-specific evidence you would need.

The disciplined reader does not collapse manuscript, edition, and translation. That separation is what makes grammatical analysis historically meaningful rather than merely decorative.
