Parsing Legal and Regulatory Sentences

Legal Indonesian uses ordinary Indonesian grammar under extraordinary pressure. A single provision may combine a defined participant, several coordinated duties, a relative clause, a condition, and an exception. The language has no special legal tense system; interpretation depends on familiar voice, modality, reference, coordination, and scope operating at high density.

This page teaches linguistic parsing, not legal advice. Real instruments are interpreted within their complete statutory context and governing legal doctrine.

Because the hardest errors concern attachment rather than vocabulary, the discussion builds on coordination and constituent sharing and negation scope.

Defined terms stabilize reference

A regulation often assigns a precise local meaning to a capitalized term.

Dalam peraturan ini, Penyedia adalah badan usaha yang mengoperasikan layanan penyimpanan data.

In this regulation, Provider means a business entity that operates a data-storage service. (constructed legal definition)

After that definition, Penyedia refers to the defined class, not to every entity that might be called a provider in ordinary conversation.

Setiap Penyedia wajib menunjuk seorang penanggung jawab keamanan data.

Every Provider must appoint a person responsible for data security. (constructed legal provision)

Istilah Pengguna mencakup orang perseorangan dan badan hukum yang memiliki akun aktif.

The term User includes individuals and legal entities that have an active account. (constructed legal definition)

Capitalization here signals local document practice; it does not turn every common noun into a proper name under general EYD V rules. First locate the defining clauseβ€”often X adalah..., X merupakan..., or yang dimaksud dengan X adalah...β€”then carry that defined reference through later provisions.

Yang dimaksud dengan Data Terbatas adalah data yang hanya dapat diakses oleh Pengguna tertentu.

Restricted Data means data that may be accessed only by specified Users. (constructed legal definition)

The first yang dimaksud dengan frames the term being defined; the later yang hanya dapat diakses... modifies data inside the definition.

Wajib, harus, dapat, berhak, and dilarang

Regulatory predicates assign different normative statuses.

Pengguna berhak memperoleh salinan catatan transaksi miliknya.

A User is entitled to obtain a copy of their transaction record. (constructed legal entitlement)

Penyedia dilarang mengalihkan Data Terbatas kepada pihak ketiga tanpa persetujuan tertulis.

A Provider is prohibited from transferring Restricted Data to a third party without written consent. (constructed legal prohibition)

English legal shall does not correspond to one universal Indonesian word. A duty may use wajib or harus; a prohibition often uses dilarang; an institutional power may use dapat. Translate the normative function, not the English surface form.

First identify the modal predicate, then ask who bears its duty, permission, entitlement, or prohibition. Everything else may be embedded inside that normative frame.

A constructed provision, dependency by dependency

Consider this deliberately dense but grammatical provision:

Penyedia wajib menyimpan catatan transaksi yang dibuat Pengguna selama lima tahun dan, apabila diminta secara tertulis oleh Pejabat Pengawas, menyerahkan salinan catatan tersebut paling lambat tiga hari kerja setelah permintaan diterima, kecuali catatan yang penyimpanannya dilarang oleh undang-undang.

A Provider must retain transaction records created by Users for five years and, when requested in writing by the Supervising Officer, submit copies of those records no later than three working days after the request is received, except records whose retention is prohibited by law. (constructed regulation)

Parse it in layers:

  1. Penyedia is the subject bearing the duty.
  2. Wajib scopes over two coordinated predicates: menyimpan and menyerahkan.
  3. Catatan transaksi is the object of menyimpan; yang dibuat Pengguna modifies that object.
  4. Selama lima tahun measures the retention duty.
  5. Apabila diminta... is inserted next to menyerahkan and states the condition for submission.
  6. Salinan catatan tersebut is the submitted object; paling lambat... sets its deadline.
  7. Setelah permintaan diterima locates that deadline relative to receipt.
  8. Kecuali... removes a specified class of records from the preceding requirement.

The commas around the inserted apabila clause help readers see its local attachment. They do not create a new legal rule by themselves.

An explicit neutral paraphrase separates the dependencies:

Penyedia harus menyimpan catatan transaksi Pengguna selama lima tahun.

The Provider has to retain Users' transaction records for five years.

Jika Pejabat Pengawas meminta salinannya secara tertulis, Penyedia harus menyerahkan salinan itu dalam waktu paling lama tiga hari kerja.

If the Supervising Officer requests a copy in writing, the Provider must submit it within at most three working days.

Kewajiban tersebut tidak berlaku bagi catatan yang menurut undang-undang tidak boleh disimpan.

That obligation does not apply to records that, under the law, may not be retained.

The paraphrase is easier to read because each sentence states one major dependency. It should not silently replace the source in an actual legal interpretation; it is a grammatical diagnostic.

Coordinated conditions and their scope

With dan, all coordinated conditions normally must be satisfied; with atau, one alternative may suffice, though legal definitions can give the terms specialized scope.

Izin diberikan apabila pemohon telah membayar biaya dan menyerahkan jaminan pelaksanaan.

A permit is granted if the applicant has paid the fee and submitted a performance guarantee. (both conditions)

Permohonan dapat diajukan melalui portal elektronik atau dikirim melalui pos tercatat.

An application may be submitted through the electronic portal or sent by registered post. (alternative procedures)

Bantuan diberikan kepada warga yang kehilangan tempat tinggal dan tidak memiliki sumber penghasilan tetap.

Assistance is provided to residents who have lost their homes and do not have a stable source of income. (both properties modify warga)

The last yang clause coordinates two predicates under the same relative head warga. Repeating yang may highlight two independent criteria:

Bantuan diberikan kepada warga yang kehilangan tempat tinggal dan yang terdaftar dalam basis data daerah.

Assistance is provided to residents who lost their homes and who are registered in the regional database. (constructed criterion)

Numbered presentation does not automatically settle whether an initial condition governs every item.

Jika keadaan darurat ditetapkan, Kepala Daerah dapat: a. menutup akses ke lokasi; b. membatasi kegiatan umum; atau c. memerintahkan evakuasi.

If an emergency is declared, the Regional Head may: (a) close access to the site; (b) restrict public activities; or (c) order an evacuation. (constructed enumerated power)

Here the initial jika clause naturally governs all three coordinated powers because the colon introduces them as complements of dapat. A line break alone would not prove that analysis if the syntax were different.

Relative nesting

Legal noun phrases can contain a relative clause whose own noun contains another relative clause.

Pemohon yang menggunakan kuasa yang belum terdaftar wajib melampirkan surat kuasa asli.

An applicant who uses a representative who is not yet registered must attach the original power of attorney. (constructed nested relatives)

The first yang modifies pemohon; the second modifies kuasa. The modal wajib belongs to the outer subject, not to kuasa.

Dokumen yang memuat data yang diperoleh secara tidak sah tidak dapat dijadikan dasar keputusan.

A document containing data obtained unlawfully may not be used as the basis for a decision. (constructed legal provision)

Lembaga yang menerbitkan sertifikat yang masa berlakunya telah habis harus mencabut sertifikat tersebut.

An institution that issued a certificate whose validity has expired must revoke that certificate. (constructed legal provision)

Trace each yang back to the nearest plausible head, but check meaning and argument structure. The nearest noun heuristic helps; it does not replace analysis.

Negation and exception scope

Negation can reject an action, a permission, a requirement, or only one coordinated member.

Pemohon tidak wajib menyerahkan salinan yang telah tersedia dalam sistem.

An applicant is not required to submit a copy already available in the system. (absence of obligation)

❌ Pemohon wajib tidak mengungkapkan kata sandi kepada pihak lain.

Scope-transparent but unnatural legal wording for an obligation of non-disclosure.

The first means there is no duty to submit; it does not prohibit submission. Legal Indonesian more naturally expresses the second as a prohibition:

The applicant is prohibited from disclosing the password to another party. (natural legal wording)

Exceptions introduced by kecuali, kecuali jika, or selain must be attached to a clear rule.

Kendaraan dilarang memasuki kawasan tersebut, kecuali kendaraan darurat.

Vehicles are prohibited from entering the area, except emergency vehicles.

Penyedia tidak boleh menutup akun, kecuali jika Pengguna meminta penutupan secara tertulis.

A Provider may not close an account unless the User requests closure in writing.

Rewrite a dense provision as separate propositions: rule, bearer, conditions, exception, and consequence. If the exception could attach to two different propositions, the source remains scope-ambiguous despite neat numbering.

Common Mistakes

Translating English shall as future akan

❌ Penyedia akan menjaga kerahasiaan data.

Wrong modal force if a legal duty is intended β€” akan normally marks future reference or prediction.

βœ… Penyedia wajib menjaga kerahasiaan data Pengguna.

The Provider must protect the confidentiality of User data. (legal duty)

Reading tidak wajib as a prohibition

❌ Pemohon tidak wajib hadir berarti pemohon dilarang hadir.

Incorrect interpretation β€” tidak wajib removes a duty; it does not ban attendance.

βœ… Pemohon tidak wajib hadir, tetapi tetap boleh mengikuti sidang.

The applicant is not required to attend but may still participate in the hearing.

Attaching a condition only by line position

❌ Syarat pada baris pertama pasti hanya berlaku untuk butir pertama.

Incorrect parsing principle β€” line layout alone does not determine syntactic scope.

The scope of a condition is determined by sentence structure and cross-references. (legal/academic)

Losing the head in nested relatives

❌ Dalam β€˜dokumen yang memuat data yang bocor’, yang bocor pasti dokumen.

Incorrect β€” the second relative most naturally modifies data.

βœ… Dokumen yang memuat data yang bocor harus diamankan segera.

The document containing the leaked data must be secured immediately.

Treating an exception as a separate free-standing permission

❌ Frasa β€˜kecuali petugas medis’ sendiri berarti semua tindakan petugas medis diizinkan.

Incorrect β€” the exception removes a class from a particular rule, not from every rule.

βœ… Larangan masuk berlaku bagi semua orang, kecuali petugas medis yang sedang bertugas.

The entry prohibition applies to everyone except medical personnel who are on duty.
