Legal and Regulatory Malaysian Malay

Legal Malaysian Malay does more than sound formal. Its modal choices assign duties, confer powers, recognize rights, and prohibit conduct; its numbering tells readers exactly where a condition or exception attaches. A fluent everyday paraphrase can therefore be legally wrong if it turns hendaklah into a suggestion, boleh into a duty, or berhak into a mere possibility.

This page teaches how the language works, not how any real law applies. The regulation, institution, defined terms, dates, rights, and duties below are wholly fictional and have no legal effect.

Pengguna hendaklah memulangkan Kad Akses sebelum meninggalkan premis.

Hendaklah is an operative modal (legal/formal). Although hendak elsewhere can express intention or future orientation, the enclitic -lah in this legal formula does not make the rule friendly or optional. It imposes a duty on the grammatical subject Pengguna.

Pendaftaran awal adalah wajib bagi setiap Pengguna.

Advance registration is compulsory for every User. (legal obligation)

Wajib predicates obligatory status of pendaftaran awal. Its attachment differs from the first example: the required thing is a registration, whereas hendaklah directly governs what the User must do.

Pengurus boleh melanjutkan tempoh penggunaan selama satu jam.

The Manager may extend the period of use by one hour. (discretionary power)

Here boleh confers power; it does not promise that every request will receive an extension. Translating it as “will extend” deletes discretion, while “can extend” may be ambiguous between practical ability and legal authorization. In an English legal rendering, may is usually clearer.

Pengguna berhak menerima alasan bertulis bagi apa-apa penggantungan.

A User is entitled to receive written reasons for any suspension. (legal right)

Berhak puts the entitlement with the User. Boleh menerima would only say that receipt is possible or permitted; it would not guarantee the same legal position.

Pengguna dilarang memindahkan Kad Akses kepada orang lain.

A User is prohibited from transferring the Access Card to another person. (legal prohibition)

The passive-shaped dilarang makes the prohibition explicit. A negative such as tidak digalakkan means “not encouraged” and is far weaker.

A fictional Malaysian-style regulation

The following instrument is original teaching material. Capitalization and numbering are intentional.

PERATURAN-PERATURAN RUANG BACAAN KOMUNITI (PENGGUNAAN) 2028

1. Nama dan permulaan kuat kuasa

(1) Peraturan-Peraturan ini bolehlah dinamakan Peraturan-Peraturan Ruang Bacaan Komuniti (Penggunaan) 2028.

(2) Peraturan-Peraturan ini mula berkuat kuasa pada 1 Julai 2028.

2. Tafsiran

Dalam Peraturan-Peraturan ini, melainkan jika konteksnya menghendaki makna yang lain—

“Kad Akses” ertinya kad yang dikeluarkan oleh Pusat kepada seorang Pengguna;

“Pengguna” ertinya seseorang yang telah didaftarkan di bawah peraturan 3;

4. Penggantungan dan hak untuk menerima alasan

(1) Tertakluk kepada subperaturan (2), Pengurus boleh menggantung Kad Akses jika Pengguna melanggar perenggan 3(2)(a) atau (b).

(2) Sebelum membuat penggantungan, Pengurus hendaklah memberikan peluang yang munasabah kepada Pengguna untuk memberikan penjelasan.

5. Pengecualian kecemasan

Walau apa pun perenggan 3(2)(b), Pengurus boleh membenarkan pintu keselamatan dibiarkan terbuka semasa pemindahan kecemasan jika tindakan itu perlu untuk melindungi nyawa.

Definitions stabilize meaning

“Kad Akses” ertinya kad yang dikeluarkan oleh Pusat kepada seorang Pengguna.

“Access Card” means a card issued by the Centre to a User. (legal definition)

The quotation marks and capital letters identify a defined term. Once defined, Kad Akses is not merely any access card; it has the instrument's stipulated meaning. Ertinya is definitional (legal/formal), not a conversational way of asking what a word means. The introductory exception melainkan jika konteksnya menghendaki makna yang lain prevents the definition from mechanically overriding a context that clearly requires another reading.

Definitions can expand or narrow ordinary meaning. That is why translators must not silently replace a defined term with a stylish synonym. If Pengguna is defined as a registered person, later Pengguna cannot be broadened to every visitor.

Conditions and exceptions attach locally

Tertakluk kepada subperaturan (2), Pengurus boleh menggantung Kad Akses jika Pengguna melanggar perenggan 3(2)(a) atau (b).

Subject to subregulation (2), the Manager may suspend an Access Card if the User breaches paragraph 3(2)(a) or (b). (legal condition and cross-reference)

Three pieces limit the power. Tertakluk kepada subperaturan (2) subordinates it to the hearing requirement; boleh makes suspension discretionary; jika supplies the triggering breach. Moving the opening phrase to a remote paragraph could make its scope uncertain. The legal syntax guide develops these attachment patterns across longer provisions.

Walau apa pun perenggan 3(2)(b), Pengurus boleh membenarkan pintu keselamatan dibiarkan terbuka semasa pemindahan kecemasan.

Notwithstanding paragraph 3(2)(b), the Manager may allow the security door to remain open during an emergency evacuation. (legal exception)

Walau apa pun perenggan 3(2)(b) is an override formula (legal/formal): for the stated emergency, the prohibition on leaving the door open does not control to the contrary. The narrower cross-reference avoids displacing the unrelated registration and card-transfer rules in regulation 3. The following jika condition—necessity to protect life—still limits the exception. A plain paraphrase must retain both the override and that condition.

In a long provision, draw brackets around the main modal and every condition: [subject] [must/may/is entitled] [action] [if/subject to/notwithstanding]. Attachment is part of meaning, not punctuation decoration.

Enumeration and cross-reference

Subregulation 3(1) ends its first two paragraphs with semicolons and connects the final item with dan. All three are cumulative requirements. Subregulation 3(2) uses atau, so either prohibited act can independently breach the rule.

The reference perenggan 3(2)(a) atau (b) points to two paragraphs inside subregulation (2) of regulation 3. It does not mean regulations 3, 2, and an undefined item (a). Preserving parentheses and hierarchical labels is essential in translation and quotation.

Plain-language paraphrase without lost force

Here is a nontechnical explanation of the fictional rules:

Anyone who wants to use the work room after 8:00 p.m. must register, provide a reachable telephone number, and obtain an Access Card. A User must not give the card to anyone else or leave the security door unattended. If either prohibition is breached, the Manager has discretion to suspend the card, but must first give the User a reasonable chance to explain. A suspended User has a right to written reasons within three working days after the suspension. During an emergency evacuation, the Manager may permit the door to stay open when that is necessary to protect life.

The paraphrase shortens definitions and cross-references but preserves must, must not, has discretion, has a right, and may. Plain language is not permission to turn binding rules into advice.

Common Mistakes

1. Weakening hendaklah

❌ Pengguna sebaik-baiknya memulangkan Kad Akses.

Wrong force for the provision—this says the User should preferably return the card.

✅ Pengguna hendaklah memulangkan Kad Akses.

A User must return the Access Card. (binding legal duty)

2. Turning discretion into obligation

❌ Pengurus mesti menggantung Kad Akses bagi setiap pelanggaran.

Wrong force—this removes the Manager's discretion and adds universal suspension.

✅ Pengurus boleh menggantung Kad Akses jika syarat yang dinyatakan dipenuhi.

The Manager may suspend an Access Card if the stated conditions are met. (discretionary legal power)

3. Weakening a prohibition

❌ Pengguna tidak digalakkan memindahkan Kad Akses.

Wrong force—this merely discourages transfer.

4. Detaching an exception from its condition
