Parsing Legal and Regulatory Sentences in Malaysian Malay

Legal and regulatory Malay uses the ordinary resources of the language—modals, passives, relative clauses, coordination, negation, and exception phrases—but packs them at exceptional density. It does not possess a special legal tense system. The difficulty lies in determining exactly which definition, condition, prohibition, or exception has scope over which constituent.

This page teaches a method for parsing constructed legal-style provisions, not legal advice and not an inventory of basic linkers. Punctuation and numbering help readers navigate, but neither can substitute for tracing the grammatical dependencies inside a sentence.

Start with defined terms

Legal documents reduce repetition by assigning a fixed meaning to a term. A common definitional frame uses ertinya “means”:

Dalam Peraturan-Peraturan ini, ‘premis makanan’ ertinya mana-mana bangunan atau kawasan yang digunakan untuk menyediakan, menyimpan, atau menjual makanan.

In these Regulations, ‘food premises’ means any building or area used to prepare, store, or sell food.

Once defined, premis makanan must be read with that stipulated scope, even if everyday usage might be narrower. Mana-mana is (legal/formal) here and distributes over every building or area meeting the description. The relative clause beginning with yang modifies both coordinated heads bangunan atau kawasan.

‘Pegawai diberi kuasa’ ertinya pegawai yang dilantik secara bertulis oleh Ketua Pengarah.

‘Authorised officer’ means an officer appointed in writing by the Director-General.

The words after ertinya are not merely background information: they determine who counts as the defined participant. When a later provision says pegawai diberi kuasa boleh memasuki premis, the appointment condition travels with the defined term.

Build a definition ledger before parsing operative provisions: defined term → head noun → restricting conditions. Do not silently replace a defined term with its everyday meaning.

Find the operative modal and its subject

Legal sentences normally have an operative core. In obligations it may contain hendaklah, wajib, or mesti; in prohibitions, dilarang or tidak boleh; in permissions, boleh. Their legal force depends on the instrument and jurisdiction, but their syntax can be identified directly. The obligation guide compares the core modal meanings outside this unusually dense register.

Pemegang lesen hendaklah menyimpan rekod jualan selama tujuh tahun.

The licence holder shall keep sales records for seven years.

The subject is pemegang lesen, the operative modal is hendaklah, and the required act is menyimpan rekod jualan. The duration modifies the keeping obligation.

Mana-mana pengendali yang menerima notis itu wajib memberikan jawapan bertulis dalam tempoh empat belas hari.

Any operator who receives the notice must provide a written response within fourteen days.

The relative clause yang menerima notis itu restricts which operators bear the obligation. It is not another required act.

Orang awam dilarang memasuki kawasan itu kecuali dengan kebenaran bertulis.

Members of the public are prohibited from entering the area except with written permission.

Here dilarang scopes over memasuki kawasan itu. The exception introduced by kecuali narrows the prohibition; it does not create a general permission unrelated to entry.

Coordinated conditions: identify the operator

Legal consequences often depend on multiple conditions connected by dan or atau. Preserve the exact coordination.

Lesen boleh dibatalkan jika pemegang lesen memberikan maklumat palsu atau gagal mematuhi notis pembetulan.

A licence may be revoked if the licence holder provides false information or fails to comply with a rectification notice.

The atau means either breach can satisfy the condition. Replacing it with dan would require both. Conversely:

Bayaran balik hanya boleh dibuat jika borang lengkap diterima dan identiti pemohon disahkan.

A refund may be made only if the completed form is received and the applicant's identity is verified.

Both coordinated passive conditions fall within the jika clause. The focus particle hanya narrows the permission: without both conditions, the regulation does not authorize the refund.

Lists may visually separate conditions, yet the introductory grammar still controls them. If a provision says jika pemohon—(a) ...; dan (b) ..., the final dan coordinates both items cumulatively. A line break does not turn dan into atau.

Scope of negation

Negation must be attached to the smallest constituent it actually governs. Compare:

Pegawai tidak boleh meluluskan permohonan yang tidak lengkap.

An officer may not approve an incomplete application.

The first tidak negates permission to approve; the second restricts permohonan. It does not mean that an officer is permitted to approve nothing at all.

Tidak semua pelanggaran menyebabkan lesen dibatalkan.

Not every violation results in licence revocation.

This means some violations may not result in revocation. It differs sharply from Semua pelanggaran tidak menyebabkan lesen dibatalkan, a structurally awkward sentence that can be taken to mean no violations result in revocation.

Circle each negative and draw a bracket around its complement. Tidak boleh [meluluskan X], permohonan [yang tidak lengkap], and tidak [semua pelanggaran] express three different scope relations.

Relative nesting and enumerated exceptions

Successive yang clauses can nest inside one another. Locate the nearest semantically compatible head, then test the legal logic:

Dokumen yang dikeluarkan oleh badan yang diiktiraf oleh Menteri hendaklah disertakan bersama permohonan.

A document issued by a body recognised by the Minister shall accompany the application.

The first yang modifies dokumen. Inside it, badan yang diiktiraf oleh Menteri contains a second relative modifying badan. The Minister recognizes the body, not necessarily the document.

Exceptions can also be nested:

Larangan ini tidak terpakai kepada kenderaan kecemasan, kecuali kenderaan yang digunakan bagi tujuan latihan.

This prohibition does not apply to emergency vehicles, except vehicles used for training purposes.

The first negative creates an exemption for emergency vehicles; kecuali then carves training vehicles back out of that exemption. In set terms: general prohibition → exemption → exception to the exemption. Readers who treat every kecuali as attaching directly to the original prohibition reverse the result.

Annotating a constructed regulation

Consider this invented provision:

Seseorang pengendali yang menyimpan bahan terkawal tidak boleh memindahkan bahan itu ke mana-mana premis lain melainkan jika (a) pengendali telah memperoleh kebenaran bertulis daripada Pengarah; dan (b) premis lain itu dikendalikan oleh seseorang yang memegang lesen yang sah, kecuali pemindahan yang dibuat atas arahan pegawai diberi kuasa semasa kecemasan.

An operator who stores controlled material may not transfer it to any other premises unless (a) the operator has obtained written permission from the Director; and (b) the other premises are operated by a person holding a valid licence, except a transfer made on the instruction of an authorised officer during an emergency.

The dependency structure can be annotated in layers:

  1. Subject: seseorang pengendali [yang menyimpan bahan terkawal]. The relative clause restricts the operators covered.
  2. Prohibition: tidak boleh [memindahkan bahan itu ke mana-mana premis lain].
  3. Conditional escape from the prohibition: melainkan jika introduces two cumulative conditions, joined by dan: written permission has been obtained and the destination is run by a valid licensee.
  4. Final exception: kecuali pemindahan... identifies emergency transfers ordered by an authorised officer. On the most natural punctuation and placement, this exception applies to the preceding conditional regime and licenses that special transfer without requiring (a) and (b).
  5. Nested relatives: seseorang [yang memegang lesen yang sah] contains a person-relative; lesen yang sah contains a further restriction. Pemindahan [yang dibuat...] is another relative structure.

A plain-language paraphrase is:

Pengendali bahan terkawal biasanya dilarang memindahkan bahan itu ke premis lain. Pemindahan hanya dibenarkan apabila pengendali mendapat kebenaran bertulis Pengarah dan premis penerima dikendalikan oleh pemegang lesen sah. Walau bagaimanapun, syarat tersebut tidak dikenakan jika pegawai diberi kuasa mengarahkan pemindahan semasa kecemasan.

Operators of controlled material are normally prohibited from moving it to other premises. Transfer is allowed only when the operator gets the Director's written permission and the receiving premises are operated by a valid licensee. However, those conditions do not apply if an authorised officer orders the transfer during an emergency.

This paraphrase makes the likely scope explicit. In actual legal work, an ambiguity in the enacted text cannot be settled by stylistic preference; definitions, cross-references, interpretation legislation, authoritative versions, and case law may matter.

Common Mistakes

Treating numbering as if it erased the coordinating word.

❌ Syarat (a) atau syarat (b) memadai walaupun senarai diperkenalkan dengan 'dan'.

Incorrect — 'dan' makes the listed conditions cumulative.

✅ Kedua-dua syarat (a) dan (b) mesti dipenuhi.

Both conditions (a) and (b) must be fulfilled.

Attaching a nested relative clause to the wrong noun.

❌ Dalam 'dokumen yang dikeluarkan oleh badan yang diiktiraf', badan itu mengiktiraf dokumen.

Incorrect — the second 'yang' says that the body is recognised.

✅ Badan itu diiktiraf, dan badan itulah yang mengeluarkan dokumen tersebut.

The body is recognised, and that body issues the document.

Flattening tidak semua into total negation.

❌ Tidak semua permohonan ditolak bermaksud semua permohonan gagal.

Incorrect — 'not all are rejected' allows some to succeed.

✅ Tidak semua permohonan ditolak; sebahagiannya boleh diluluskan.

Not all applications are rejected; some may be approved.

Reading an exception as a free-standing permission.

❌ Frasa 'kecuali dengan kebenaran bertulis' membenarkan semua perbuatan lain.

Incorrect — the exception only narrows the stated prohibition.

✅ Kebenaran bertulis mengecualikan perbuatan yang dinyatakan daripada larangan itu sahaja.

Written permission exempts only the specified act from that prohibition.
