Administrative and legal Serbian must identify powers, duties, procedures, deadlines, and consequences with controlled scope. It therefore favors defined terms, repeated nouns, formulaic case government, nominalizations, impersonal instructions, and patient-centered passives. Those features can be necessary; they become “bureaucratic” when they hide actors, pile up empty nouns, or make a public instruction harder to follow.
Legal drafting and an explanatory letter are not the same register. A regulation may need exact repetition to prevent ambiguity, while a notice to a citizen should normally state who must do what, by when, and how.
The available voice choices are compared under Passive Strategies, while gerundive and nominalization choices explain when an event noun hides tense, aspect, or responsibility.
Formulaic government carries legal relations
Many institutional phrases are compact because their case frame is stable.
| Frame | Meaning | Case |
|---|---|---|
| у складу са... | in accordance with | instrumental |
| на основу... | on the basis of | genitive |
| у року од... | within a period of | genitive |
| ради... | for the purpose of | genitive |
| право на... | right to | accusative |
| одлучивати о... | decide on | locative |
| поднети захтев за... | submit an application for | accusative |
Орган поступа у складу са законом и на основу чињеница утврђених у поступку.
The authority acts in accordance with the law and on the basis of the facts established in the proceedings. (legal)
Жалба се може поднети у року од петнаест дана од дана пријема решења.
An appeal may be lodged within fifteen days from the date the decision is received. (legal notice)
The repetitions in од дана пријема решења may sound heavy, but the phrase fixes the point from which the deadline runs. A plain-language explanation can say Рок почиње када примите решење, provided that it preserves the same legal meaning.
Захтев за накнаду трошкова подноси се надлежној служби.
An application for reimbursement of costs is submitted to the competent department.
Захтев за + accusative names what is requested; dative надлежној служби names the recipient. English prepositions do not predict these cases.
Modal force: may, must, and is entitled
Legal effect depends on modals. Може grants permission or possibility; дужан је да imposes a duty; има право на/да creates an entitlement; не сме prohibits; подлеже identifies exposure to a procedure or sanction.
Подносилац је дужан да пријави сваку промену адресе у року од осам дана.
The applicant is required to report any change of address within eight days.
Корисник има право да затражи исправку нетачних података.
The user has the right to request correction of inaccurate data.
Овлашћено лице не сме да открије податке трећем лицу без правног основа.
An authorized person must not disclose the data to a third party without a legal basis.
Do not translate English legal shall automatically as Future I. Serbian ће доставити may sound like a prediction; дужан је да достави explicitly imposes a duty. In another provision, present подноси се may state the prescribed procedure. Draft for the intended norm, not the surface English tense.
Nominalization and long noun phrases
Nominalizations package recurring legal concepts: подношење захтева, престанак радног односа, заштита података, накнада штете. They are useful when the concept itself is being defined or cross-referenced.
Поступак за остваривање права на накнаду штете уређује се посебним правилником.
The procedure for exercising the right to compensation for damage is regulated by a separate rulebook.
The phrase is dense but its relations are controlled: за + accusative purpose, право на + accusative, then objective genitives. Difficulty arises when several genitives permit competing roles.
Одлука комисије о одбијању захтева подносиоца достављена је пуномоћнику.
The commission's decision rejecting the applicant's request was delivered to the authorized representative.
An expert reader can parse the chain, but a public notice should often unpack it:
Комисија је одбила Ваш захтев. Одлуку смо доставили Вашем пуномоћнику.
The commission rejected your application. We delivered the decision to your authorized representative. (plain-language administrative notice to one person)
The rewrite restores actors and divides one dense nominal group into two chronological sentences. It also uses courtesy Ваш because it directly addresses one recipient.
Impersonal and passive structures
The се passive is natural for general procedure; бити + passive participle is natural for a completed institutional result.
Пријава се подноси електронски преко портала управе.
The application is submitted electronically through the authority's portal. (general procedure)
Ваш захтев је примљен и заведен под бројем 417/26.
Your application has been received and registered under number 417/26. (completed result)
The patient controls agreement: plural пријаве се подносе, пријаве су примљене. An impersonal structure can be appropriate when no individual agent matters. When responsibility matters, active syntax is clearer.
Надлежна инспекција извршиће надзор у року од тридесет дана.
The competent inspectorate will conduct the inspection within thirty days.
The active subject identifies who is accountable. Heavy од стране + genitive is possible in legal texts when the patient must remain topic, but it should not become an automatic translation of English by.
Контролу је спровела надлежна инспекција.
The competent inspectorate conducted the inspection. (active, accountable)
Decomposed predicates: conventional versus empty
Some noun–verb combinations are established terms: донети одлуку, поднети захтев, изјавити жалбу, вршити надзор. Others merely inflate a simple verb: извршити реализацију уплате instead of извршити/обавити уплату or simply уплатити.
Комисија је донела одлуку о додели средстава.
The commission made a decision on allocating the funds.
Служба ће кориснику уплатити одобрени износ до краја месеца.
The department will pay the approved amount to the beneficiary by the end of the month.
Formal style does not require извршити уплату одобреног износа кориснику if the finite verb states the same legal act more clearly. Keep the noun where it has terminological status; use a verb where the action is the message.
Definitions and controlled repetition
A legal definition may assign a shorter label: У смислу овог правилника, „корисник“ је лице које... Once defined, repeating корисник can be safer than varying it with грађанин, странка, подносилац if those terms have different legal scopes.
У смислу овог правилника, корисник је физичко лице коме је одобрена услуга.
For the purposes of this rulebook, a beneficiary is a natural person for whom the service has been approved.
Legal cohesion sometimes prefers repetition over elegant synonymy. Academic or journalistic style might vary wording, but a legal synonym can accidentally change the class of persons concerned.
Script, titles, and document organization
An institution's document follows its authorized script and house style. Serbian Cyrillic and Latin are both standard scripts, but one document should not switch accidentally. Quotations and registered names may preserve their original script.
Administrative documents commonly organize information as authority → legal basis → operative decision → reasoning → remedy/instructions. A reader-friendly notice instead begins with outcome and required next step. Address is formal: Поштовани господине..., Ви/Ваш in direct correspondence, or third-person defined roles in a general act.
Serbian titles use sentence-style capitalization, and quotation marks are „…“. English title capitalization and curly opening “ should not be imported.
Parallel rewrite 1: operative rule and user instruction
Захтев се подноси на прописаном обрасцу, уз доказ о уплати административне таксе.
The application shall be submitted on the prescribed form, accompanied by proof of payment of the administrative fee. (general administrative rule)
Попуните образац и приложите потврду да сте платили административну таксу.
Complete the form and attach confirmation that you paid the administrative fee. (plain-language instruction, polite/plural)
The rule uses impersonal procedure, nominal доказ о уплати, and no individual address. The instruction uses Ви-imperatives, chronological verbs, and lower information density. Both can be accurate in their intended document.
Parallel rewrite 2: legal decision and public explanation
Захтев се одбија као неоснован због неиспуњености услова прописаног чланом 8.
The application is rejected as unfounded because the condition prescribed by Article 8 has not been met. (legal operative language)
Одбили смо захтев јер нисте доставили доказ који члан 8. захтева.
We rejected the application because you did not submit the evidence required by Article 8. (plain-language explanation to one recipient)
The legal version categorizes the decision and grounds; the explanation names actor, recipient, missing item, and cause. Plain language must preserve the right to appeal and exact deadline even when it simplifies syntax.
Practice
Task 1: Preserve legal force
Rewrite a provision containing може, дужан је да, and не сме as a public information box. Keep permission, duty, and prohibition distinct.
Task 2: Unpack a noun chain
Turn a long phrase about the commission's rejection of an applicant's request into two short sentences. Annotate actor, patient, deadline, address form, and discourse order.
Common Mistakes
Wrong case in a formula
❌ Одлука је донета у складу са важећи закон.
Incorrect—у складу са governs instrumental: важећим законом.
✅ Одлука је донета у складу са важећим законом.
The decision was made in accordance with the law in force.
Translating legal shall as a prediction
❌ Подносилац ће пријавити промену адресе, ако се сети.
Incorrect for the intended binding duty—the future plus ако се сети turns an obligation into a contingent prediction.
✅ Подносилац је дужан да пријави промену адресе у року од осам дана.
The applicant must report a change of address within eight days.
Stacking empty process nouns
❌ Извршена је реализација спровођења исплате средстава.
Incorrectly inflated—the nested process nouns obscure the simple completed payment.
✅ Одобрена средства су исплаћена корисницима.
The approved funds were paid to the beneficiaries.
Combining passive strategies
❌ Захтев се је одбијен од стране комисије.
Incorrect—се cannot combine with је + passive participle, and the agent is more clearly expressed actively.
✅ Комисија је одбила захтев и доставила образложење подносиоцу.
The commission rejected the application and delivered the reasoning to the applicant.
Key Takeaways
- Formulaic prepositions and cases encode legal relations and must be preserved exactly.
- Distinguish permission, obligation, entitlement, prohibition, and prediction.
- Nominalization is useful for defined procedures and concepts but harmful when it hides actor or sequence.
- Use се for general procedure, a periphrastic passive for completed patient-centered results, and active syntax for accountability.
- Plain-language rewriting should reduce density without changing legal scope, deadlines, or remedies.
